THE NEW JAPAN Online Store Terms of Use

These Terms of Use (hereinafter, “these Terms”) set forth the conditions governing the use of the product sales services (hereinafter, “the Service”) provided on “THE NEW JAPAN Online Store” (URL: thenewjapan.com, hereinafter, “the Site”), operated by NOT A HOTEL Inc. (hereinafter, “the Company”).
Customers using the Service (hereinafter, “Users”) agree to these Terms before using the Service.

Article 1 (Application of These Terms)

  1. These Terms apply to all matters related to the use of the Service between Users and the Company.

  2. Notices, guidelines, and other instructions posted by the Company on the Site from time to time (hereinafter, “Supplementary Notes”) shall constitute a part of these Terms.

Article 2 (Use of the Service)

  1. Users shall use the Service in accordance with these Terms, the Company’s separately established Privacy Policy, and all Supplementary Notes.

  2. Users shall, at their own expense and responsibility, prepare all communication devices, software, and other equipment necessary to use the Service.

Article 3 (Purchase of Products)

  1. Users shall apply to purchase products using the method prescribed by the Company.

  2. A sales contract between the User and the Company shall be deemed concluded when the Company reviews the User’s application and sends an email confirming acceptance of the order (order confirmation email).

  3. Users who are minors must obtain the consent of their legal guardian (such as a parent) before applying to purchase products. The Company shall deem that such consent has been obtained when accepting an order from a minor.

  4. The Company may refuse an order or cancel a concluded sales contract if any of the following apply: 

    1. False, incorrect, or omitted information in the application (name, delivery address, etc.)

    2. The User has previously violated these Terms and had their use of the Service suspended

    3. The Company determines the order is for resale or other commercial purposes 

    4. The product is out of stock, or an incorrect price was displayed due to system errors

    5. Any other case where the Company deems the order inappropriate

Article 4 (Payment)

  1. The payment methods available shall be displayed on the Site’s purchase process page.

  2. Users shall pay the product price, shipping fees, and any other required charges in accordance with the terms of the chosen payment method.

Article 5 (Delivery)

  1. Products shall be delivered via the delivery service designated by the Company.

  2. After payment is completed, the Company shall ship products within the period specified in the “Notation Based on the Act on Specified Commercial Transactions.” Delivery may be delayed due to weather, traffic conditions, holidays, or other circumstances.

  3. If delivery fails due to incorrect address information, refusal of receipt, prolonged absence, or similar reasons attributable to the User, the Company may cancel the sales contract. In such cases, the Company will not refund the product price and may charge round-trip shipping fees and handling charges.

  4. Ownership of the product transfers to the User when the product is handed over by the delivery company.

Article 6 (Returns and Exchanges)
Returns and exchanges shall be handled in accordance with the “Returns and Exchanges” section of the “Notation Based on the Act on Specified Commercial Transactions.”

Article 7 (Handling of Personal Information)
 The Company shall appropriately handle personal information obtained from Users—such as names, delivery addresses, and email addresses—in accordance with the Company’s Privacy Policy.

Article 8 (Prohibited Acts)
Users shall not engage in any of the following acts, or acts that may lead to them, when using the Service:
 

  1. Acts that violate laws or public order and morals

  2. Criminal acts or acts related to criminal activity

  3. Infringement of the Company’s or third parties’ copyrights, trademarks, or other intellectual property rights

  4. Acts that damage the Company’s or third parties’ property, privacy, honor, or credibility

  5. Acts that interfere with the operation of the Site (including unauthorized access or transmission of viruses)

  6. Purchasing products for resale or other commercial purposes

  7. Impersonating another person when using the Service

  8. Any other acts deemed inappropriate by the Company

Article 9 (Intellectual Property Rights)
All copyrights, trademarks, and other intellectual property rights related to the content provided through the Site and the Service (including THE NEW JAPAN magazine content, text, images, videos, designs, etc.) belong to the Company or the rightful owners.
Users may not reproduce, repost, modify, publicly transmit, or otherwise use such content without the permission of the rights holder.

Article 10 (Suspension or Interruption of the Service)
1. The Company may suspend or interrupt the Service, in whole or in part, without prior notice to Users, if any of the following apply:

  1. System maintenance or updates

  2. Inability to provide the Service due to force majeure (fire, power outage, natural disaster, etc.)

  3. System or communication failures due to accidents

  4. Any other reason the Company deems it difficult to provide the Service

2. The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to suspension or interruption of the Service. 

Article 11 (Disclaimer)

  1. The Company does not guarantee the completeness, accuracy, certainty, or usefulness of the Service or the information obtained through it.

  2. Except in cases attributable to the Company, the Company shall not be liable for delivery delays, accidents, or failure to receive products due to the User’s absence.

  3. Users acknowledge that the appearance of products (color, shape, etc.) may differ from the actual product depending on the User’s device settings.

  4. If damage is caused to a User due to reasons attributable to the Company, the Company’s liability shall be limited to the purchase price of the product that caused the damage. This limitation does not apply in cases of willful misconduct or gross negligence.

Article 12 (Changes to These Terms)

  1. The Company may change these Terms at any time without obtaining User consent if deemed necessary.

  2. Revised Terms take effect when posted on the Site. If a User uses the Service after the changes, they are deemed to have agreed to the revised Terms.

Article 13 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.

  2. Any disputes arising between the User and the Company related to the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
